he was caught on video walking off with it hanging out his notebook. security said because they didnt see him pick it up. they cant do anything. told me not to mention it cause he could get me for slander!

First of all, what was it that he stole from you? Was it something that related to work, or was it a person item? I understand you said it was hanging out of his notebook, but there are several personal things that would be included in that.

Security videos are submissable in a court of law. That's something they will not tell you. Even though it was not a visual of him actually taking the item, it is, however, visible that he left with something. It's obvious security doesn't want you making waves, but if I knew I wouldn't lose my job over it, I would certainly do so anyway.

Theft of ANY kind, large or small, is most definitely illegal. For instance, when you were not in your space, why is HE there? What was his purpose for going to your desk and why is security being 'nonchalant' about it? These are a couple of questions you must ask yourself, then take it to an attorney. Do NOT let your rights be stifled because once they 'take from you', they will do it again. It's only a matter of time. Don't let ANYONE get away with that or you'll be set-uped to be used all the time. They will know that they can take from you and go unpunished.

I would tell everybody about it anyway. Not a public announcement or anything, but in one to one conversations I would mention to not trust so and so because he is a thief and he stole this from me, etc. Then you make spreading the word about him as protecting those you tell. Soon, within telling 4 or 5 people, he will be ostrosized. Nobody will want to even talk to the SOB. Gosh I hate thieves.

Businesses have to be very careful of this because it could cause more problems and could cost them a lot of money even if it was a $1000 dollar camera.
You are just going to have to accept it. Some people are just bad.
