The U.S. patent office and copyright laws have serious prohibitions against patenting or copyrighting any living organism or part thereof, including DNA, bacteria, viruses, etc.

Since it's obvious nobody can ever recreate your baby's genetics, unless she is cloned against your will, I doubt you should worry about it. And the whale in question doesn't even have a basis to CONTEST why you should copyright it, as it's been around millions of years longer than you have, and its discovery was undoubtedly many years prior to your birth (regardless of your age).
