First of all you have to have suffered some form of measurable damages. Did you get put in the hospital by this expired milk? Did you incur medical expenses or lose time from work? Secondly you would need to show they were negligent. Was the expiration date missing or removed? Does this company(I'm assuming you mean the store) have a track record of selling products past their expiration date?

Also, do you understand that the date stamped on the milk is not the date it turns bad? You usually have up to a week after the date before it really starts to noticeably go bad, so even if you neglected to look at the date and bought it you still have time to use it before it starts tasting bad. And did you ever think of just returning it for you money back or exchange for a new carton?

If I were the Judge I'd have 3 questions.

My first question would be,
How did you know it was expired?

My next question would be,
So you knew it was expired?

My last question would be,
Did you buy it?

Yes, but you need to prove an injury and that the expired milk caused the injury. Your best bet is to report them to your attorney general.

I really dont understand WHY you would want to take a company to court for such a small thing such as MILK.


BUt consider this, it isn thte companys fault, its the stores fault, wait nvm, haha you meant the store.

No. They have to label it, but you have to read the label. Can they take you to court for acting a fool?
