If you choose different names for the real characters of the story, is it still labeled as non-fiction? Or is it 'based on a true story?'

Are you purporting it to be reality? If you're "changing the names of the guilty" (as it were), then it's still non-fiction. If you're taking moments or situations that really occurred and / or peoples' personalities to fill characters...

That's called fiction. We all do it. It's experience. You'll do well to mix the things up a bit, though, to keep yourself out of "trouble" with people you know. You've heard authors or actors saying things like, "Well, it's composite of people I knew." That's what they're on about.

Again, if you're just changing names but writing autobiography and wanting to publish, do make sure that you make it clear that this is your perception, to your recollection and in your opinion what happened. That way it's not liable.

Based on a true story.
If anyone can recognize themselves in it, you'd better cover your tracks and say based on a true story, some names of characters and places changed for privacy.

I would say based on a true story. And you may need to slightly alter some characters, as if somone recognises themselves you may risk being sued.
