I live in Mo and my ex-husband lives in KS. He is frequently late in his child support payments and so I began having his wages garnished. Every year he quits his job in Oct. and finds a new one in Feb. Well, this year (I hear) that he's found one that pays him cash. I've called SRS in KS (NO HELP) and DFS in MO (Helping but slowwwwly). He has a warrant out for his arrest in MO for failure to appear on a warrant issued on the last time he stopped paying child support. It's been 5 1/2 months since we've got a dime and we are HURTING for money. At what point does failure to pay child support become a felony? He is supposed to pay $250 a month plus $50 back child support for all the months he's missed. He is also supposed to provide our son with insurance and doesn't do so. I hear that if MO will extradite him then he will be under a judge's order to pay back ALL the money he owes and will have to provide insurance..... is this true and if so, WHEN will this happen and how can I help?

First of all Dale, I am NOT your honey. Don't ever presume to refer to me as such. For your information I work full time and go to school full time. In YOUR world $250 may not be much, but in mine it is. My child needs braces AND medical insurance. You and your stupid answer are dismissed.

Listen moron........ I live on my own now and work and go to school full time. My life has changed. Not that it is any of your business. If you don't have any advice then shut up. I don't want or need your pity or opinion. I asked for an answer on a SPECIFIC question. Do you have an answer for that specific question? The question isn't whether or not YOU think that my son should receive child support and insurance. The court system has already decided that. Perhaps you would prefer that I quit working and go on welfare? Would that make you happy? No, I guess that wouldn't either. Either pony up a response to this question or go take your judgmental tirade on the road. For Godsakes, I'm asking a question on how to get back child support and insurance on my child. Shall I have the state step in and pay for that? People like you really annoy the **** out of me. As far as a roomba goes, what do you care if I wish I had a roomba? Do you feel the need to destroy my dreams?

you do know that your entitled to ask for interest on any arrears he owes, right?

you do know that you get a 'cost of living' increase every 2-4 years (depends upon the state)?

you have many options, for there are many laws. the amount you get in child support is laughable. i would call my caseworker and ask for a review of his income. if he works under the table, report him (and his employer) to the IRS.

if ever your caseworker (or dept) isnt on the ball, pull rank on 'em and write the Attorney Generals (both states), as well as the states Regional FEDERAL Child Support Office (both states).

Unfortunately for you, your life with your children will be a real financial struggle until you can get through school and get a better job/career. I'm not sure that he will get a felony, but in our state, the Court will appoint jail time if the person is over $2000 behind on child support which most Judges don't like to give jail time because the bad side to an ex that goes to jail means he won't be able to work a job to financially support his children. Our Court will appoint a job to a person and will Order an Income Withholding order and Medical Insurance to be provided. Your ex is a dispicable and horrible role model for your children and he's giving the message loud and clear he doesn't love them in their eyes. $250 is peanuts to raise a child on which doesn't even cover the cost of clothing and food. He should be grateful that he only has to pay $250 a month or $62/week for 3 children. I feel really bad for your situation because it's not going to be easy for you and your family. Even if they extradite your Ex it will still be a slow return for getting child support from him. At this time and it may be for a temporary time until you get on your feet, you may qualify for state assistance with health insurance, housing, child care, food, etc. Utilize what's available to you until you get on your feet. I would go to your local Family Services Bureau and check out what's available to you and your children. I hope you have good emotional support because you are fighting a long uphil battle. Just pick up your boot straps, hold your head up, be as resourceful as possible, find a second income if you haven't already, liquidate if you have anything to liquidate and set a budget for rice and beans, beans and rice because you may have to live like no other, to someday live like no other. Yes, if a judge extradites him, which they will based on amount owed, then he could get in some serious trouble. The way to speed things up is to collect child support payments from the state. This puts pressure on the state to collect from him. Now, as far as missing child support becoming a felony; I don't think so. Just be happy he will get jail time since the back payments continues while he is in jail and he will have to pay on it until it is all payed up to the state. Also, I am sure you have an attorney, make sure you sue for the insurance, damages to your character, mental health damages due to your personal stress, and etc.

Unfortunately Missouri is not very hard on deadbeat parents. If they do catch him they will most likely put in jail for a couple of months or probation for a year. Then after that they will give him 30 to 60 days to get a job and they will garnish part of his pay. If he gets behind during his probation they will put him back in jail. Good luck...I've been trying to get a child support order enforced in MO for 17 years without luck.

From what I have seen in Child Support Enforcement in two States, they just sit and wait for the payments to be made. Florida will request that drivers licence be suspended (if other State agrees), Arkansas will promise you the world (good luck).A friend of mine is waiting to see if tax return is guaransheed from two ex's. In the mean time, she has a job because the bill collectors don't care. Check on medical insurance in your State for your kid(s). Florida and Arkansas both have KIDS programs that cover medical expenses.

I am glad to see a parent pursuing the rights of their child. You must stay on the hunt. Thing to keep in mind each state is different. My state will take away driver's license and incarcerate. Also look into any assets, tax returns, etc. I am continuously amazed at the length non custodial parents will go through to avoid financially contributing to the upbringing of their children. Never, never stop the hunt. Your child deserves to be raised by both. Take a look at my website and maybe something in there will assist in building your strategy. You know I actually felt sorry for you when I first read your question then I was very happy to your response to Dale. Then I read your other posts. You need to get a life. If you live with your parents what bills do you pay???????? I don't like the fact of a deadbeat father but I don't like the fact that a mother continually picks losers for husbands either. You need to grow up and figure this out on your own.

First of all you can help by moving to KS and allowing your child to see his/her father.
You live with your parents and your ex con husband, you want someone to pay for your sister to go to a fat farm, you only work 20 hours a week and go to school full time and are in the market for a Roomba????
That is one really messed up life... if it is true.

I am afraid you need to take a good legal advice. But, I would advise you to live on your own means and try to earn it, by sheer hard work, while you pursue the legal battle with your ex. Some times, it is really sickening to go to courts every now and then, seeking a redress of your case, however justified your claim could be. You might as well leave him alone, and come to terms with life without him and his money.

Honey, we are not talking about a lot of cash here. Not enough to make or break you. First, get a job, second get some self respect, last, move on and stop complaining. If the money means that much to you, then your child does not mean enough!
Stop wasting the tax payers money to conduct your revenge on your ex. Stop wasting the time of the courts.
Stop wasting your energy that should be focused on your child.
