My brother just got arrested for possession of marijuana and DWI for the second time (on both charges) in Texas. What sort of punishment is he faceing from the judge?

- A person convicted of DWI for the 2nd offense may have their driving privilege suspended for not less than 180 days or more than 2 years.
- A fine not to exceed $4,000.00.
- Confinement in the Jail for a term of not less than 30 days nor more than one (1) year.
- Community Service: State law mandates that a judge order not less than 80 hours nor more than 200 hours.

a 2nd DUI in Texas, probably jail time and the circumstances, having drugs on him does not help. He could be looking at anything from 60 days in a county lock-up or 2 yrs or more in the state system. With it being his 2nd offence, it will be considered if he was on probation from the first offence or any other offence also the time frame between 1st and 2nd offences, obviously if it has been 6 months since the 1st time, that won't go as well if it has been 6 years.

maybe 90 days in jail and a outpatient treatment program, if all he has on his record is a DWI and nothing other major. my advice is to get a lawyer for him. it don't have to be a spendy one just something better than a public pretender.. The Mary Jane is nothing they will drop that charge with any plea deal.
You can find DWI attorneys for cheap.

In California nothing. Most likely you get sent to rehab or required to be in a rehab program as a condition of probation. Other states I am not too sure. Unfortunately, for drugs you must usually break the law about 5 different times or be prosecuted with intent to distribute before you serve any time.

Drug laws are WAY to soft..and yet we have a system (in all states) overcrowded because of drugs. It is pathetic that people want to ruin their lives over this garbage.

Depending on the judge, they will probably discuss placing him in a substance abuse program as well as jail time. I do not know the laws in your state but his attorney should probably ask for that he be placed in one. He really needs help.

hopefully a good long one that he will learn from. My dad was killed by a drunk driver!


Drug court and a week or more in jail, probation,community service liencse taken and have to go through a lot to get them back. A breatha lzer in th car etc. In the nd it s like thousands of $$$$ and a lot of time.

He is in deep s%%%, no way around it.

It'll be awhile before he is allowed to drive a car, and even if he could, his insurance premiums would be, well,you realy don't want to know.
