Depending on the age of consent laws in your state, it may be. Ultimately, it's not the age difference, but if she's old enough to consent to sexual relationships and each state has it's own statutes on that.

You can look them up at the site below for your state:

It may be illegal depending on where you live, but it is probably not. Each U.S. state has it's own "age of consent" laws regarding what is the minimum age that a person may legally consent to sexual activities. Violation of these laws is called "statutory rape", becuase they are considered sexual offenses, but the person is not being forced, it is only illegal by statute.

The laws vary (widely) by state, and the relative age of the two parties is often also a factor in addition to the age of the younger party.

The legality of your specific instance is 100% dependent on where you live. In MOST states, the situation that you have described is perfectly legal; however it's not something that you want to be taking chances with.

For a summary of statutory rape laws by state (current as of 2003), consult the list below. Then either consult an attorney in your area, or at least look up your most recent state legislation on the Internet—laws do change, so better safe than sorry.

It depends upon what state you live in and what is considered the age of consent in the state you live in. Some states it is 16 and others it is 18. If the age of consent is 18 and you are 18 you are considered an adult and she is considered a minor. You could be brought up on charges of statutory rape.

It depends on state laws... but Technically yes.

If her parents find out and have an issue with it they can get you on statutory rape... again it depends on the state laws.

So you would be better off waiting!

Even if you have been with her for a long time and have done it before you turned 18.. that still won't keep you out of trouble with the law if her parents get upset about it and choose to take that route.

If you are over 18 and she is not, then yes, technically it's illegal, BUT...... someeone would have to report it for you to get in any trouble. (her arents, a friend, etc.) Some states the age is a little younger, I think, 16, or 17, but rule of thumb is at 18 she is legaly able to consent to sex.

Depends on what the age of consent is, where you live. If it's 18, then yep, pretty sure that would technically be considered statutory rape, since she's underage and you're not.

Well in the state I live in (SC) you're okay. It really varies from state to state. 17 sounds about right to me though, if she were 16 I know that would be illegal somewhere.

Well anyone under 18 is a minor, so yes it is illegal. Her parents can charge you with rape if you have sex with her. You are considered an adult and should know better. Wait till she is 18 and be safe. Unless you like the way a jail cell looks.
