I have been in trouble making the car payment, for the last
3 month I have been warning from my lender that they are going to repose the car , my question is this ,, can they actually came to your garage and get the car , what if my wife lie to them and tell that I am not home and went out of the state , would they still has the authority to go inside my house garage to look for the car
what are the rules , what can they do and what they can not do

First of all, it's not your car. It's the bank's car, otherwise they couldn't repo it.

Now that that's settled, the rules are that you pay for things or people can take them back. You got a secured loan...the bank has a lien on the vehicle and can repossess it if you don't live up to your obligations. You're not, so there you go.

Do they have the right to search your home? No.

Do you run significant civil (and possibily criminal) risks for keeping it and not paying? Yes.

If you negotiate a return of the vehicle, you may save yourself some money. They'd tack the repo fees (and possibly the damage to the vehicle from gaining access) onto what you owe.

No...they should not have the authority to break into any structure containing the vehicle or enter your house without permission...unless they have a Marshall with them and a court order to seize the property.

If you're not going to be able to make it good...you might as well just get it over with and turn the car back to them. It is their legal right to expect you to honor the contract. You'll only hurt your credit even worse.

depends on the repo order. they can get an order to go onto private property but most the basic repo order is the need to be on public property. So yes they can stay on the road and hook up to your car in a drive way but the tow truck can not be on your private property. Depends on your state but I am guessing at three months past do the order is to tow from anywhere. At least that is the way it was like 10 years ago.

I don't know if they could enter your garage and take your car, but they can get a writ of reposession and bring the sheriff there to take back possession of your vehicle if you fail to surrender it on demand and are in arrearage on your payments, which violates your agreement with them. If you would try to work with them, they may be able to refinance the rest of the loan. Good luck.
