It all depends on what state you live in. Some states allow someone who is underage to drink if they're parents are present. Wisconsin has a law like that.

No, it's still illegal. Some restaurants will turn a blind eye if an adult orders the drink and the drink is served to the adult but there is nothing in the law that allows it.
