My fiance has been working in the U.S. for a few years with his H1B (also just had it renewed), and we'll be getting married this June. Are there any more steps that we need to take before getting married, or is the filing for residency done after the marriage? Does anyone know if there is more paperwork to be done beforehand? Thank you in advance for all your help.

H1B is a dual intent visa. That means that your boy friend can choose to immigrate or not to immigrate. You can marry him and get him a conditional green card which will be made permanent after the conditional time period elapses. You need your marriage certificate etc. Check forums like immigration.com which concentrate more on different types of immigration. You might find FAQ's or step by step procedures as well.

The problem is that an H1B is a NON immigrant visa. Marrying a US Citizen indicates the desire to be an immigrant and could mean a violation of his status.

If he was not an H1B visa holder he would just go to the US Embassy and get a K visa. I would make an appointment with www.cis.gov

You might want to have a look at your options on visajourney.com. There is a Canadian forum there and I'm sure someone there will have done just this and can give you some good advice. It is my understanding that after you marry you will apply for Adjustment of Status and your husband will become a permanent resident...but I may be wrong, so check it out.
