To get extremely pedantic about it, it's only illegal if you're downloading something that's copyrighted AND the copyright holder does not allow you to distribute it (which is the case for most mainstream music, movies and commercial software). But there are things that are copyrighted but use licenses that allow distribution, like Creative Commons or any Free Software license.

Only if you are using it to download non-copyrighted materials.
If you are downloading Copyrighted programs, videos or music that you do not already own a copy of, then it is illegal.

What isn't legal is using them to copy and distribute commercial material that should be paid for (just like making copies of your CDs and giving them to your friends).

Well its legal as long as u aint downloading Non copyrighted stuff then its illegal but i use it and i havent gotten any troubles

ya things like downloading movies are illegal statutory damages can be as much as $30,000 per motion picture, and up to$150,000 per motion picture if the infringement is willful.

Using them to trade files that you have created is legal. Using them to trade commercial files that are under copyright (music, movie, software etc) is illegal.
