I was wearing my seatbelt, it kinda sags so i guess it might have looked like i didnt have it on. Besides how can a cop goind 65 mhr down the highway see if i have it on or not. I had it on when he pulled me over.

seat belt tickets are possibly the hardest to fight... i have never heard of one being dismissed. i would contest it all the way to the end. Argue that you did have the belt on, but you took it off when the officer pulled you over to get the ins/reg. You probably won't get it dismissed, but you will at least make them put some work in to steal your money.

It's hard to say how you would fight a seat belt ticket without knowing the facts of the case.
Did you buckle up?
Did you admit to the officer that you did not buckle up?
Did you take off the seat belt without telling the officer?
Although it might be an expensive ticket in some states, you should go to court and tell the truth. If you have mitigating circumstances, tell the judge. I don't know if the judge would have the discretion to lower the fine, but you can always ask.

In some states you can't be cited for a seat belt violation unless you have been stopped for a moving violation first! If that is the case the police can't ticket you! If he doesn't cite you for the stop, it would be hard for them to then say you didn't have your seatbelt on as that sounds like a bogus stop!
If the above isn't the case, it is your word against his and you will never win that one!
In my state we do not have a mandatory seat belt law for adults!

You are right about it being difficult for a cop to see your seat belt at highway speeds if he was going the other way. What I do suspect is that he saw something else he wanted to stop you for and after stopping you, the seat belt was all that could be justified. I would consider my self lucky and pay the fine.

Why would you try? In Kansas it is a $10 fine and that's it. Just pay the ticket and go about your business. Next time, wear your seatbelt.

In a word? you can't. If you weren't wearing one then your gilty.And if it was at night don't use the excuse of how can he see. Simple, they use infered sensors that show up at night. it will tell if you had one on or not. Your best defence is to go to cort and hope the officer dosent show. If he dosen't then the cort should throw it out because you have the right to face your acuser. If the officer does show then humble yourself to the cort and ask for a reduced fine.Most corts will. Best bet. wear seatbelts.

There really is no useful defense to a seat belt violation other than arguing the PC for the stop, which is also pretty much a lost cause. Most fines for seat belt violations are minimal, so why don't you just pay it and wear your seat belt in the future?

You really cant fight it, its your word against theirs. If you really didnt have it on cause you are forgetful like me, get a car with automatic seatbelts so you dont have to put it on. No tickets for me since i've had them :)

Did you have your seatbelt on? If so, you might be able to contest it in court.
If you DIDN'T have your seatbelt on, you should pay the fine and start buckling up.
