My brother has just been released from jail on his own recognizance but is now being held by the immigration service as he's an illegal immigrant in the US. Will he be deported or kept in the country until his criminal trial is heard?

Few more details - It's a felony charge, he did 4 months in prison before he got OR and the Imm service have had him for 2 weeks but he is not allowed to contact us. Not being local we don't understand some terminolgy, will he have to wait in the US (and therefore in Imm custody) for his criminal trial?

Either way, he'll be deported. They probably put him on trial, and when he's found guilty, be deported. If he's found innocent of the criminal charges, he will be deported for illegally entering the US. The only question is WHEN he'll be going back.

It depends on the charge. If it's a misdemeanor they tend to just deport them. If it's a felony he'll serve his time in prison and be deported upon completion of his time.

Depends if they know his status in this country if the immigration know he is an illegal immigrant he will be deported

They are not supposed to be released on bail because they tend to run. While we want twice illegal aliens to do their jail time before they are sent back, rather than just have them disappear before their trial, ICE will send them back.

I don't know enough facts in your case to predict an outcome.
