My doctor (orthopedic) performed surgery on me in Jan.06. I saw him once, six weeks after surgery, on a follow-up. Since then I've been back 4 times, in hopes of having a face to face with him. Each time I am told he is only seeing new patients and that I will have to see his Physcian Assistant. I tell the P.A. that my back is worse now than before the surgery. The CT scan verifies my complaint. The PA always tells me he will advise the surgeon of my condition and he will get back to me with an answer. The answer never seems to come and I can't see the surgeon. Should I threaten him with legal action?

Call your insurance company as well, alot of insurance companies like to hear feedback about their customers doctor. They may be able to help and in the future there will be documentation to support your claim if you want to pursue it legally.

How do you know you CT scan 'verify's your complaint?' If indeed it showed a problem, I find it very difficult to believe the surgeon is not involved with it. Over what period of days are you speaking? I think it's too early for an attorney, but, that's my thought. I think you need to call the office and ask for the MANAGER. Whenever I've had issues, I find they are the most helpful in getting them resolve, whether about the doc or office staff. In the meantime, if you trully have problems, you can seek help in the ER. They could rule out any emergent needs.

You have to get a second and maybe even a third opinion before you obtain an attorney. Then if your surgeon wont see you, and you really DO have just cause........sure......obtain an attorney.
But seems to me, most surgeons and DRs are scared to death of malpractice suits so there must be a reason he isnt listening to your every word.
Did you complain at every whipsticth of the procedure? Were you badmouthing him to others before you ever gave him a chance? MIND YOU..i dont KNOW YOU, Hunii, im just trying to figgure out the situation here, because seems to me he would be scared crapless of you!!!!! So, go get your 2nd opinion and then go back~!! and GOOD LUCK!!!!!!

Your state should have a medical board that might help in the long run, but probably not. Doctors have a tendency to not want to censure other doctors. There is also the AMA, but there is the same problem as with the state. There are other doctors out there, so maybe you should try to find one who is more caring and responsive to their patient's problems and concerns.

Call your family doctor. Tell them you are in pain and not getting the care you need.
Find your films and get a new doctor with the help or without the help of your family doctor.
Call your insurance company and speak to someone there.
Until you speak to someone you can complain about and write down the date, name of person(S), etc.

Don't go back there unless you are getting your records.
Take them before you start all of the complaining and get yourself treated. Don't put it off past Monday.
