In the decree he was awared the house. I just simply couldn't afford it...neither can he. I had NO idea this could happen or else would have requested we sell the house instead of letting him keep it. He intentionally fell behind 4-6 months on payments to qualify for a "Hardship Loan" on his 401K and not be penalized a % so this was the first Bomb Shell that hit my credit and made me aware of the situation (after the fact of course) no he consistently is behind 2 or more months. I can't so much as get a store credit card. In order to have my name removed from the loan he has to refinance - which he is unable to qualify for - or sell it - which he refuses to do. I can't afford an attorney to try and force a sale and seek damages so I am lost and furious! This is completely ridiculous! Has anyone ever delt with this before?

Sorry to say this but you are screwed. If he refuses to sell and can not qualify to refinance in his name only and you are on the loan with him there really is nothing you can do.

Your lawyer should have found this out before your divorce was final.

i recently went through adivorce in august of 2006 and your attorney should have had you sign the deed over to him therefore removing your name from it. I had this happen to me with my ex wife she was not on the loan when we first separated and would not help with mortgage so i pretty much had to force her into financing it or letting it go to forclosure because she would not sell. I would call the mofrtgage company ask them to remove your name or go to your state office which keeps the deeds and find out how to get it removed because you are divorced and he was awarded the property.

You did sign a quit claim deed right? Send a copy of the deed and your divorce decree to the credit reporting agency's.And explain your situation to them. This should work for you.
