I have some W2 income from NC. I also have some W2 income from NY and 1099 (misc) from NY.

Yes, you need to file a NC non-resident return lisiting only the income earned in NC. Whether or not you get any refund from NC will depend upon your tax liability there and how much tax was withheld.

You then file a regular NY resident return, listing all income from all sources. You'll get a credit on your NY return for any taxes paid to NC.

For the 1099 income, you'll need to file Schedule C with your Federal return (and whatever NY's equivalent is on the NY return) to account for the business income and expenses. If your net profit from the business activity is $400 or more, you also need to attach Schedule SE to calculate the Self-Employment tax from the business activity.

If you had state taxes deducted from your earnings in NC you probably should file as a non-resident and atleast get some if not all of the taxes that were deducted back.
