Check with an attorney, I think that the age where she can choose which parent she wants to live with is 12. Maybe call the state attorney office for Oregon? Unless you both have something else in your custody agreement for her where she has to wait for a specific age.

Well I know in the state of NJ, they have a say in court at age 13. Though it all depends on the maturity of the child, whether she understands situations or not.

She needs to go to court. It isn't up to her in the long run...she can express that she wants to live with her and will be asked her reasons. Depending upon her answers and what the court feels is in her best interests either she will be living with you or living with her father.

All I know in this matter is that she can emancipate herself at 14. I don't know what rights she has at 13. I'd call a legal office and ask.

I would assume you can petition to the courts at any time. If she wants to live with you, and dad agrees, then she can, if he doesn't, and she does, go to the courts. They will do what is in her best interest.

I thought it was 12. But check with a lawyer. If she wants to go, just make dad's life a living hell until he wants her to leave.
Have her try dating one of his friends (pretend). That would get him.

you have to check with the court call a lawyer and ask them you will have to have custody transfered to you if you get her you won't be resposible for paying child support
