is this an infringement of my human rights.surely in this country we are innocent until proven guilty.ie the police have to prove it was me who was driving the vehicle at the time the offence occured, but if i take this to court i would have to prove it was not me who was driving at the time.

No. You have to prove YOU were NOT driving, not the other way around. And the camera doesn't lie - so you are guilty.
Anyway, you WERE speeding, you DID get caught, and now you have to face the consequences.
Just think - you could have killed someone.

The police send out a NIP (Notice of Intended Prosecution). This is addressed to the registered keeper and asks who the driver of the vehicle was on the date, time and place stated. It is a legal requirement of the owner of the vehicle to furnish the information of who the driver was at the time of the "alleged" offence. So if you were not the driver at the time of the "alleged" offence, then the driver will be the one who gets the points on the licence and the fine. Hope this clears up any misunderstanding.

And what about the right to life of the victim you might kill when you hit them with your speeding?
One thing people should consider about the human rights act when trying to use it in this way is the the annoying people who abuse the whole concept of the act in order to get themselves off after breaking the law or to justify their own wrong doings. Like the prisoners who were deprived of their drugs for instance.
At the end of the day, the majority of drivers break the law at some point, you just run the risk of getting caught when you do break the law.
You were unlucky, live with it.

It is not an infringement of your human rights, to have received the summons etc, they will have proof of the vehicle doing that speed, its up to you to prove it was/was not you driving at the time. If you are the registered keeper of the vehicle and it has been caught on camera for speeding, then you have to face up and pay up, or chase and report the person who was driving

i think that since it was your car, it is reasonable that you should explain why it wasn't you, if it wasn't. From what you say, it seems that you WERE driving the car but are trying to be clever to avoid the penulty. You write about your "human rights"; what about your human RESPONSIBILITIES? i.e. that you drive within or at the designated speed which is for EVERYBODIES' protection. Why do you seem to think it's o. k. for YOU to drive too fast. Grow up and stay off the road until you can behave like an adult.

No. But you are required by law to name the driver. As the owner of the vehicle you should know who was driving as they would have needed your permission. If you fail to name the driver you will not be fined for speeding but you will be fined for not nameing the driver.

The idea is to stop you speeding and it might do as the points add up. You could say that every law infringes your human rights but don't bother - all that has been tried before and to no avail. Pay up and forget it but don't speed in future

Someone I know as caught on a speed camera and he said he didn't know who was driving... him or his wife. He then had to go to court but because the magistrate didn't have a photo because one had never arrived in time he said that ,"Well ,one of you was driving so you had better decide who is going to take the points." So the husband took them. I think he was scared to argue for fear of getting a stiffer penalty.Sometimes the points go to the owner /keeper of the vehicle. I totally agree with what you are saying but the rip off speed camera laws don't seem to give us a leg to stand on.

you got caught so just pay the fine..... you must of seen the sign warning about speed camara.. so do what everyone else does slow down for camara then when its gone speed up again....
unless you can prove you was not driving the car which i take it you cannot.... we have speed limits for a reason...

A lot of the cameras out there can photograph the driver as well as the car so, learn your lesson and take the consequences of your irresponsible behaviour.
