I am trying to make my Brother in-law a dependent, but i don't know how to do it.

You'd have to be his legal, court appointed, guardian AND he'd have to be 100% disabled. If BOTH of these are the case then take your documentation down to the personnel office and they'll get the paperwork started for you.

Dependents are those persons under age 18 or in college. If your brother-in-law is not entirely dependent on you for his health and welfare, you are going nowhere with this idea.

you must provide at least 50% of ALL his expenses for 12 months and claim him as a dependant on your income taxes before you can apply to have him claimed as a depended for military benefits. the military will thenmake a detremination, and they can deny it for any reason.

You wont be able to. I had custody of my niece and provided 100% of her support and the military would not let me claim her as a dependent.

I think you are out of luck unless he has sever medical issues that you are paying for. You need to be paying 50% plus of a persons living expenses and you need to show proof. They may have an issue with him not being blood family. I don't remember the exact reg for this stuff, but they don't make it easy for a reason. It is also just for medical in most cases not housing. Go to your personnel department and legal department to get the exact correct information for you branch of service.

What do mean 'military dependant'(sic)? A dependent is someone whos welfare you are financially responsible for, whether you're military or not. If he's somehow disabled and you're paying for all his upkeep, OK, he'd be 'other dependent'. Is he handicapped? Is he under 25 and a student? He's not overseas and you're trying to claim him, are you? Naughty, naughty.

You can't, he is your BROTHER in law. He is not considered a dependant.
