No you will not get arrested, he is just trying to scare your mom. but you need to hide your car, (park it at a friends house or something) until the payments are caught up. They can come to your work and take it.

No. The tow truck driver can't and the bank usually won't. Of course if you get stopped by the police kiss the car goodbye. Not to mention your credit at this stage of the game stinks.
But in some states I would imagine this can be considered criminal. It is theft of a service or goods. So why not make the payments deadbeat? Unless of course you plan on going through life getting something for nothing. Thats fine if you like dealing with pawn shops and places like The Money Store for the rest of your life because no decent lending institution will give you credit.
I think they need to bring back Debitor's Prison and Workhouses. Guys like you would keep them packed.

Was the car awarded to the ex in a divorce, or is there no divorce involved? If they were awarded the car, unfortunately, there is nothing you can do. And yes, you would still be liable for the loan. If the divorce documents state that the ex gets the car, and that it would be refinanced, removing your name, and they failed to refinance it, you may be able to go back to court and have the car awarded to you. If these don't apply to you, you are stuck paying for the loan, and you'll likely never get the car, unless you "steal" it back to your house. Then the ex can "steal" it back and the cycle continues, as the car is legally titled/registered in both names. Also, something you may need to know, if the ex gets a DUI in that car and there is personal injury and lawsuit, you can be brought into the suit, as you are considered a legal owner of the car, so any assets and such could be at risk. The DUI is an example, it could be any illegal activity where the car is involved.

Well, they can't arrest you for theft unless you willfully are avoiding them. However, they can repo it, I would NOT suggest HIDING or avoiding them and trying to make a payment, banks don't care... you were late and that's that. My fiance had his vehicle repo. I suggest being as cooperative as possible, so no damage is done to the vehicle. They will resell the vehicle and if it is not sold for the amount you owe (lets say less than) they will charge you for what is owed and if there are damages you will pay for those as well. Whatever you do... do not hide from these people, talk to them and be as calm as possible. Let them know your schedule so they are aware that you are not just avoiding them. If you avoid them you are working on digging a really deep hole. Trust me.

It is just a scare thing they do so they don't have to keep hunting you down.
Now if you actually try and hide the car there may be more they can do, but not at first, Just get home, and let them come get it, ( most likely they will just come tonight and get it when you are asleep( unless they know where you work, and it may be gone when you go out to go home

No. You bought the car with the agreement that you would pay for it. However, if you try to flee to another location with it with the express purpose to avoid paying for it, then that could be considered to be theft. I suggest you quit smoking, stay out of the bars and direct that money to your car payments. You'll be surprised at how easy a car payment is to make when you direct the money wisely. You'll be surprised how much more money you have when you quit spending it on destructive habits...

They would first have to have a court order sent to you. After that, possibly they could charge you with auto theft.

No they can't arrest you for it. Don't let the SOB tell you that they can. He's just trying to scare you into giving him the car without any trouble.
