k, the first question I have, is why in the world would a 20 year old want anything to do with a sophmore? What could you possibly have in common? Can you come out, or is it too late cause you have to go to high school in the morning? Need help with your homework? Yikes!
And, yes, age of consent varies from state to state.

yes it is only because he is under 18 so that makes him a teenager once he is over 18 and no problem I am 37 and I been dating 23 year old and 26 year old and currently a 48 year old

Yes, it's illegal, because he's a minor, and yes, you could be charged with stautory rape just like you would if you were a 20 yr. old guy dating a 16 yr. old girl.
He's still a kid, leave him alone.
