Yes and no, it depends on country of origin. Length of stay and other financial factors. Ultimately the Consular Officer at the Embassy of the United States nearest to your spouse will determine if the visa will be granted. Even if the visa is granted it can still be denied at the point of entry to the U.S.

I am not sure if permanant residents have to right to petition for family members. I think it is only citizens, but I will check for you. Ultimately the green card will have to go threw USCIS

Remember It is the country of origin is important!
example : If you are Filipino it is a 16 year wait for an Immigration Visa. Most people of oversecured visas, visit on B1 visas.

There is no legislation that I know of on the hill right now about immigration visas other than an F4 visa. Which wouldnt even apply to your situation.

Immigration is a hot topic in D.C. now it will only continue to get harder as Americans jobs are outscourced.

It depends but most likely they will unless they can prove they will return such as property and money in the bank there. How far are you from applying for citizenship? If you apply for citizenship and become a citizen their application is suddenly fast track and there is no waiting period for their 130 other than processing time. Your son also would derive citizenship from you.
