He's afraid to get his precious feet dirty..
I had a cat who perched on the side of the box with only one foot inside..then would scratch the side to cover it up..
All in a personality..

My cat does the same thing. She'll sit and paw at the side of the box intently for 5 minutes after doing a #2, (sometimes even the wall next to her) but never actually touches the sand or gets anything accomplished in the covering of her mess. It's actually kind of funny to watch, because she looks sooo intent, but DUMB LOL. But I don't think she is. I don't think this is a sign of a lower intelligence. Some cats are just like that. My cat has every sign of being very smart, other than that.
Both my cats are currently in potty training (To use human toilet instead of litterbox). That way I won't have to be embarrased at the thought that my teeny apartment smells, or MIGHT smell to someone who's not used to living with cats. Both cats are doing well with the training, so I have every reason to think they're perfectly intelligent.

It's just a weird thing some cats do. I have one that scratches all up and down the wall around the litter box but keeps smelling to see if it's covered yet! I think they are missing the 'covering up with kitty litter' marble in their brain!

O My Gosh! I thought my cat had something wrong with her brain, as she does the same thing. Drives me crazy, it's like clockwork in the morning, no alarm needed, just hear her clawing the side of the litter box!! Glad to know I'm not alone!

It's because he's dominant, trying to cover it is a habit but he doesn't really want to.
What you should do is where he can see you, cover it yourself with a litter scoop, he should get the idea that you're the dominant one and will do it in future.
I don't mind if they don't cover it, I don't have to go digging through to find it, it's easier to scoop and dispose of.

It's unknown to me however, my vet tells me that it is a lot like Obsessive Compulsive Disorder (OCD).. They are afraid to touch their own urine or feces... My tabby does the same thing and I can give you one tip.. Don't waste money on litter pan liners lol
