I was just wondering would this be considered rape?
An 18 year old male or female has sex with a 17 year old person of the opposite sex. But the thing is, is that the 18 year old is doing this on their birthday and the day after this is the 17 year olds birthday so he or she will be 18 the next day.
So would this be considered rape by the 18 year old if the 17 year old also agreed to do it?

No. People can have sex at whatever age they like as long as BOTH parties agree on it. I'm not sure what the age limit is in your country/state but the age law usually only comes into play when it is rape, especially with for example a teacher and a student and the student takes the teacher to court.

The consent laws in many states of the U.S. consider this possibility and allow for a small difference in the age range of the couple. Mostly this is one or two years. You will have to check your own state laws to be sure.
