Any US citizen, unless the person is under some legal prohibition against travelling out of the country (which would include anyone currently incarcerated or most serving parole).
I'm not sure if permanent resident aliens can get one.

Only US citizens can get US passports. It is a proof of your citizenship. Anyone else, including permanent residents would only be able to get passports from the country in which they were born in or have citizenship in.
