They don't put people in jail for being immigrants, they do, however arrest illegal aliens. He'll be here until his hearing, at which time he'll be deported and refused re-admittance for a few years. Its my understanding that the harder he fights, the longer the judge will restrict his re-admittance. Best to pay the piper......

He won't be sent to jail for being an immigrant, only for being an illegal immigrant.
It depends on what laws he broke how long he will stay in jail.
For example, on a first offense crossing it is typically 2 weeks to 6 months if no other crimes are committed. The second time it can be 10 years. If he had committed a felony before being deported and returned, it can be up to 20 years.
If he committed any other crimes (ID theft etc.) that would be added on top, but subject to a plea bargain.
What was his sentence? He should have gotten one before being sent to jail.
Unless you mean he was just picked up in a raid and his status is still uncertain. In that case, if a first offense without identity theft, he may get the ability to self deport, without a sentence, however, it may take a period of time to work that out.

Your uncle would not be sent to jail for being an immigrant, {an immigrant has permission to move to this country} unless he broke a law. He would go to jail for being an illegal immigrant, { came to this country without permission} and then deported.

He should NOT have been sent to a US prision because US tax dollars will go to pay the bill. He should be sent back over the border and sent to jail there...
Or, if he loves this country so much, they hould send HIM to Iraq and let him fight for it!!!
