I don't think a law on seat belts is needed either. It interferes with the natural selection process and results in dumber population on average :(

People should be responsible for their own actions and the consequences of those actions.


There's a principle in law called Due Diligence. It says that I can't sue you for damages I could've prevented. Capische? If you break a lease, I can't just stick you for all 12 months' rent, I have to make fair effort to find another tenant ASAP and then you're off the hook.

Car drivers have to wear a seatbelt because often, after the initial collision of an accident, the cars are STILL MOVING, and need to be piloted away from cliffs, children etc. You can't do that if you're thrown from the driver's seat or if a passenger is thrown on top of you, so seatbelts are essential so you can prevent further damage.

By the time a helmet matters to a motorcyclist, it's too late for him to change the outcome of an accident. So who would care?
- The motorcyclist himself
- His insurance company
- Anyone he sues for injury or wrongful death

THAT is the problem. The motorcyclist will be injured or killed worse because of no helmet. He hasn't done his part to prevent the damages. He shouldn't be able to sue for damage he could've prevented with a helmet. Fair enough?

Outside of that he can do what he pleases, it's between him, God, the pavement and his insurance. (who likely will give him a much better rate if he wears a helmet.)

I think motorcyclists should be allowed to not wear a helmet if they will sign a sworn affidavit that they will bear all future costs of healthcare should they sustain injuries as a result of not wearing a helmet.

That's my only argument for them wearing a helmet, that we taxpayers shouldn't be expected to pick up the bill when they get a head injury from not wearing a helmet. If they are willing to assume full financial responsibility for this risk, then they can do whatever they want.

That being said, the only reason the guys who race superbike have careers that last more than a few months is because they wear full helmets, chest protectors, and leathers. Those guys can get up after a 140 mph wreck and wave to the crowd because they are being smart and protecting themselves, otherwise they'd be meatloaf salad.

People who compain about visiblity are just buying cheap helmets or have bad habits and are looking for lame excuses.

Of course you should wear a helmet when riding motorcycles, just as you should wear a seat belt when driving a car.

That said, I don't believe either should be required by law.

Truthfully I think that shoud be up to the operator of the bike. HOWEVER....... I do strongly feel that people on motorcycles who wear flip flops, loose shorts and a T-shirt, should maybe SERIOUSLY re-evaluate their lives.

I also find it INFURIATING when people on motorcycles travel between cars during traffic jams on the highway or use the shoulders as thier own lane..... what makes you so important that you can drive around the mess also???

I am NOT saying that I don't like people who drive and ride motorcycles and its really only a few reckless people who give a bad image to the rest of the group.

Yes, they should wear helmets. I work in a photolab and we get pictures for the local PDs and sheriff's dept. Ive seen waay too many motorcycle accidents with people not wearing helmets. None of them usually survive.

Some state require helmets, some don't. I don't think it is fair to the tax payer to pick up the tab when someone doesn't take reasonable precaution. Insurance only covers so much and then people expect Medicaid to clean up the mess.

helmets cause many wrecks by restricting vision and hearing,,
they also cause driver fatigue..
the California law was passed after bell helmet divided 5 million dollars up between the crooked legislators as campaign contributions...helmet laws suck

Its law in the UK to wear a helmet on a motorcycle.

In California motorcycle riders have to wear helmets, its a law.
