I am applying for H1 this october. My husband is in US on H1 from jan 2007. I am not planning to go on a H4, instead I wish to go in H1 in Oct 2007 directly. If I admit that my husband is in US, will they wrongly assume that we will not return and reject my visa? What should be the answer if they ask?

The "intending immigrant" clause in US immigration law does not apply to H1 visa applicants, so it doesn't matter if your husband is in the US, or even if you intend to return home or not. If your petition is genuine and you are qualified for the visa, you will receive it. So you can tell the truth.

I always thought H1 were limited by country of origin ?

Do not ever give out more info than you must.Believe me just answer the q nothing more.They will not ask about your husband.
