Though we are not married we havesplit after 18 years. He wants to legitimize the kids but I thought we had to do this when each of our children were born . We filled out the papers stating he was the father as I was the mother. What's the simplest way or website to find this info. to be sure he is known as the father and how to recieve copies. I reside in Middle Tennessee.

First off, all children are legitimate. There is no such thing as an "illegitimate" child. It's just a word that society created to create shame amongst parents, which you should NOT buy into.

If you are asking about making him a legal parent, that is something different. I would suggest contacting a lawyer who deals in family-law. Most will do consultations for a reasonable fee, even if you don't utilize them for the actual legal process.

Well in New York if hes on the birth certificate its legal. If hes not on the birth certificate he has to sign a certificate of paternity and have it signed by two witnesses and notarized. Then it has to be turned in to the county registrar. If he had to sign a certificate when the children were born, you can check with social services or the registrar to see if they have any record of it. If he doesnt want to sign it, you can have a paternity test done. This will prove he's the actual father and therefore has to pay child support. But be careful though. He may have to pay back child support if you've never been married. My sister-in-laws now husband had to do this even though he lived with her and his kid and supported them both. There was no actual record of him having ever paid her for child support and he ended up getting arrested for non payment. My SIL had to bail him out and he had to write checks to her and have her cash them so there was a record of child support. And they garnished his wages for back child support. Which didnt really matter because it went straight to my SIL anyway.

If he is the father listed on the birth certificates then you are already done. You can send to your states records department (Department of Vital Statistics ) for certified copies. Here in Oregon it costs $19 per copy.

If he is listed on the birthcertificate, it shouldn't be a problem. I'm not quite sure what else you are wanting. If you want copies of the birth certificates, you should be able to get them from the vital statistics office in your county.

Technically that would require you being married before before their birth. Other than that, if his name is on the birth certificate and they have his last name, that's about all you can do for legitimacy. For him to receive copies, he probably has to make a request for them just as you do.

If by "legitimize" you mean prove that he's the father I would say if you file for child support or he for visitation they will give you a paternity test or accept him as the father legally.
