Right well basically I went out to celebrate my 21st bday with some friends, we had too much to drink. Left the club we were in due to this but stopped off in a shop on the way home, whilst we were in there we started acting very child-like. Throwing things at each other, the shopkeeper grabbed my friend and we tried to calm the situation down. Somehow we ending up getting into a little scrap with him, the police were passing and we were arrested for assault and criminal damage(to stock).
No history of violence for any of the 3(of us), first offences, what do you think our punishment will be?

I know it was very stupid and believe me its the first time I have ever hit out or even argued! Brought upon by myself

Like everyone else, I don't think you will have jail time for a first offense. Unless someone is really to make an example of you, then they will bargain it down to some misdemeanor charge. You will, however, have the criminal record. If your state offers a First Offender Program, and you don't intend to be stupid again, you might take it. It's a once in a lifetime deal and it seals the records for the most part.

Cautions, fixed penalty notice or possibly a court hearing if you plead not guilty.
Whatever happens you'll probably have to pay the shopkeeper some sort of compensation. If it does goto court it might be worth asking if you can do some unpaid work for the shopkeeper, opr pay him some compensation if this means you'll avoid a criminal record.

It depends on the injuries caused to the shop keeper. If they are minor you are looking at getting yourself a criminal record, a fine and having to pay compensation for the injuries and damage. Like you said it was stupid but if it's a first offence they will consider that, this time anyway.

I strongly doubt if any of you will get jail time, but on that same note it depends on the injuries the shopkeeper sustained. You can probably be looking at 1) probation 2) community service 3) alcohol treatment program (AA) 4) restitution 5) anger management..............and hey don't worry about it so much, we all make mistakes and bad judgements.

Whatever punishment you get you will now have a criminal record. This may prevent you from applying for certain types of job.

I hope you don't want to join the police or work with children. Never mind you can always become a politician.

Probably banged up for a 10 year stretch.

Seriously though if you plead guilty then you'll probably get a fine, maybe community service and damages & costs for the shopkeeper.

If the shop keeper presses charges, and you've got no previous criminal record, you'll get a fine for the stock, and a slap on the wrist, nothing more, the coppers will try to scare you a little, nothing to worry about, i doubt very much it will even go to court, though if it does, plead guilty, say your sorry, explain your were drunk and you regret every second of it, and it will never happen again, and that you've learnt your lesson, and they'll send you on your way. trust me. :-)

I would think that you could plea bargan this case into disorderly conduct with court upervision (s0 it goes off your record after two yrs)if you agree to pay for damage and shopkeeper agrees to drop Criminal damage to property.

This could happen with a short meeting with the states attorney.
If he does not seem willing to do this then contact a criminal attorney.

Worst case scenario I would think would be
Retribution and two years probation. Of course this would go on y0our permanent record so option 1 is best

Probably a fine, community service at worst. Write a letter to the shop keeper expressing sincere regret and get your brief to tell the magistrate you've done this. Look really fightened in court and show remorse and you might get away with a small fine to cover the damage.
