Well I was pulling over he must have taken off his person a needle, cut can and empty baggie because the police found these under passenger seat. They said I be arressted to even though I told them they were not mine and the guy finally admitted they were his. No drugs were found. I did not no he had warrents. I did no of his history. They even gave me a sobity test I passed and they finally let me go home. Can I be arrested for what he put in my car? Today has been three days since it happened. Even the head of drug team was there.

The circumstances you refer to about whether you can be arrested or not is this:

You have what is known as "control and dominion" over your vehicle. As such, you are responsibile for what's inside your vehicle.

The law also has a term referred to as "constructive possession." Meaning that because you have control and dominion over the vehicle, contraband within the vehicle is yours.

The officer obviously did a pretty good job in his investigation as he was able to get the truth from your passenger.

Because the passenger of your vehicle admitted to those items being his...you have nothing to worry about! He will be charged...not you!

you are not going to be arrested, THIS TIME however you very well could have been.in the future, select your passengers more carefully. next time there may be drugs and they may turn up under your seat or stashed in your belongings. the guilty party wont always tell the truth and the cop wont always take the time to extract it. remember...your vehicle and its contents are your responsibility

If it is in the car that you are driving (even if it isn't your car, or your drugs) they can arrest you for it if noone else claims it. The only way they will arrest the passenger is if it is on them or they claim it.

well if the driver only gets like a speeding ticket, he will get his ticket and be free to go, the passenger however will get a free ride in a shiny police car!

If he had not admitted that they were his...YOU WERE GOING DOWN AS WELL....If there is illegal objects / drugs in a car...both get charged unless one steps forward....

possesion is 9/10ths of the law. all i can say is shut up, get a lawyer, and let him fight your case.
