Rocio is right. A visa is only permission to apply for entry into the US. Once there, the right to stay and for how long is decided separately. That is the way US law works. A tourist, for example, could enter on the day before his visa expires yet still be allowed to stay for up to six months. Students can can stay for years while they study legally; they only need to apply for a new visa when they need to leave the US and then re-enter.

As for marrying someone with an expired visa, even someone who has overstayed is allowed to marry under state laws. That doesn't, however, mean they are allowed to stay.

Expired visa means that the visa is no longer valid, that's it. You can remain legally in the USA with an expired visa. BEFORE THE VISA EXPIRES you need to file to the USCIS to extend or to change status, and wait for the approval or denial.
If you get denied and remain in the USA, then you will be illegal. If the petition gets approved you will stay legally in the country. The visa is not going to be renewed in the US, it will still be expired but you will be legally in the country because the USCIS approved the petition.
