Back in December, this guy hit my car and caused some damage. Since the accident was minor, and the damages were less than $500, we didn't call the police. The guy said he would pay me out of pocket, but I still have only received half of what he owes. I have all of his insurance information and I'm thinking about giving them a call. Can I still file a police report? Will it even make a difference?

If you are under the judicial minimum damage, and there are no injuries, you can file the report anytime. If you over the minimum, and/or there are injuries, the report has to be filed immediately, or as soon as is physically possible.

If a police report was not filed on the day of the accident after 3 weeks can you still report it

Which will be faster? Filing a police report or taking the person directly to small claims court? Maximum limit may be around $5000, so you may want to include interest and any other monetary damages due to the guy's lateness in responding.

I believe it is too late for the police to be involved. Have you been giving the gentleman receipts for the money he has paid? Is there any kind of written agreement between the two of you? If it is simply, he said he would, and you said, okay, I trust you, well, I think it is safe to say that you won't be seeing anymore money coming your way. Notifying his insurance company at this point, would be fruitless.

It won't make a difference this late. The police probably won't even take one at this point. Best to make a claim with his insurance.
