Yes, you can. You can sue them both in civil and in criminal court.

you would have the right to sue them for any damages they do. that would mean anything that can not be cleared up with other companies such as debts and credit accounts as a direct result of the identity theft. the court would award punitive damages in the form of cost for debts incurred, legal expenses to resolve these debts plus court costs. since there is little chance of you proving pain and suffering the only other thing you could really get is lost wages for your time spent fixing the whole mess. this is of course going to take you a good year or 2 to pull off and you still have to win in court to get the judgement. then you have to figure a way to collect.

How can you prove it? How would you find them to sue them anyhow? Even if you could sue for this, it would cost a lot of dough!

People steal others ID all the time, and then open up bank accounts ruin your credit... You can't do much about it other than report it to the authorities. If you have proof of where they use your ID to commit a crime, then the people who are victimized can press charges. You yourself cannot!

That would be bloody. Seriously you have a case (identity theft) thus you can sue them. Hell even the person who got fat from eating burgers sued McDonald's.
