What can I do if one of my dependents already filed and mailed his tax return and he stated that nobody could claim him as a dependent. He stated this by mistake since I can claim him as a dependent. Is there any way to fix/amend this error?

Just file your return and claim him. Have him file an amended return and pay the additional tax by April 17th. That's all that you need to do.

If he's already filed and his return has been processed by the IRS, you'll have to file a paper return. If his hasn't been processed, you may still be able to e-file.

He'll need to amend his return to correct it, dropping his claim to an exemption for himself.

In the meantime, you can go ahead and claim him, but will have to file by mail, since an efile will be rejected.

My son did this to me also, several years ago. Don't worry about it. Just go ahead and claim him as a dependent if he fits the definition. Otherwise, just call the IRS and they will probably tell you the same thing.
