by going to a swingers party, or a orgy with your partner, because you are having intercourse with other individuals does it make you a cheater?

In my opinion, no, it does not make you a cheater. And here is why I feel this way:

Cheating is defined as: an act of deception, fraud, trickery, imposture, or imposition. Cheating characteristically is employed to create an unfair advantage, usually in one's own interest, and often at the expense of others.

This goes back to your first question about affairs being okay. No, because affairs are in one's own interest at the expense of others... mainly your spouse.

Many people consider cheating in relationship terms to be any violation of the mutually agreed-upon rules or boundaries of a relationship, which may or may not include sexual monogamy.

Cheaters are those that are out having sex with others while their spouse thinks they are in a sexually monogamous relationship.

Swingers are not deceiving their spouse. The whole idea of swinging is total and complete honesty with oneself and one's spouse. They have mutually agreed-upon rules or boundaries of the relationship, that just does not include sexual monogamy. But it does include emotional monogamy and rules by which sexual interaction with others can occur.

For instance, some people only play with others together. Some will only do same room swap. Some are okay with each other playing solo. Some are okay with separate room activities. In all cases though, the rules and guidelines are well defined and adhered to.

Case in point, my wife and I are both okay with each other playing separately. Our rules? It has to be with someone we both know and are comfortable with. We have to let each other know beforehand, not afterward, that we are going to go see that person that day. And of course, safe sex is always the rule.
