I should have been more specific I guess. My employer is sponsoring me, but he is considering to apply for me without a lawyer. I earned my BA here in the US.

Yes,but it is time consuming.You have to know your rights and fill out the right paperwork to send to the INS.A good website for this is the INS website.Good luck.

You can not get a H1B Visa on your own. You have to have the following requirements:

H1B Visa's are mostly for professional jobs, think doctors, engineers, basically we are talking about people who have degrees in their country of origin Also these people have skills that can be used in the United States.Then after applying for a job that is most likely degree required if you get the job your employer will sponsor your H1B Visa.

If you are a university student receiving your BA, BS, or a Masters degree, or a Doctorate, or Juris Doctorate. Once you are accepted to a University. Then you have to register and attend classes..then your University will sponsor your visa.

You can have a H1B Visa sponsored by a University then get hired by a company in the United States then your employer will sponsor your H1B Visa.

I should also note people who have a H1B Visa are required to pay taxes,

Are you the worker? Why would you need a lawyer? The total responsibility for the application is with the employer.

Now, if you are the employer you absolutely will need an attorney who specializes in these matters.

not only H1B visa,you can get any kind of visa without a lawyer the important thing is you must submit strong evidence to the consular office and be confident then you should get a visa.

Yes, I'm not a lawyer, yet I process many H-1Bs for my company. You just need to make sure that all the information is correct and they are following the rules.

of course, but if the application is done wrong and sent back for any reason by the USCIS you may miss the cap. I would fork out the money for the lawyer since it seems that you only get one shot at the H-1B filing this year.
