And I said that's the stupidest thing I've ever heard!! Going 45 in a 40... freakin please.. the cop had no car, bike nothin, just walked out in front of him on the street (very very stupid on his part, its a really busy street) and gave him a ticket for 5 over. I said I would have just kept goin, if he had no way to come after me then forget him!!
But anyway, I told my friend to fight it, and the p***y he is said no... I'll just pay it. But my thought if you just take it into court it would be thrown out as a waste of time. What do you all think?

There has to be more to the story then you are telling or maybe know. I have drove all over the U. S. and always drive 5 MPH over the speed limit. I don't even get a look from the cops, and doesn't make any differences what I am driving, sports car, sedan, pickup or motorcycle. Your friend may have been driving 10 to 15 MPH over the speed limit and the cop was nice and only wrote the ticket for 5 MPH over the speed limit. So if you don't like the answers, then next time don't ask questions that are so dumb.
Note: How do you know the cop was an ahole if you weren't even there. You sure know a lot for not being there. Wish I was that smart. If you were there I can see by your remarks why there was trouble and a ticket given, so whose smart mouth caused the ticket to be given?

The ticket may or may not be thrown out depending on the affidavit, or sworn statement the officer submits with the citation. Sometimes the individual may request for a deferred finding. Essentially, your friend would pay the fine, and as long as he/she qualifies, the cite wouldn't go on his/her driving record. The citation could be dismissed, or it could be mitigated in which the fine may be reduced. Some courts don't even require an appearance for a mitigation.

As already stated, Speeding is Speeding....and thank your local government for it. Most of the times when the speed traps are set up, and yes, they are legal to enforce speed laws when there has been a major problem with speeding in the area, then the city and police chief or sheriff will set this up, and it doesn't matter if it is 1 mile over or 30 miles an hour over, it is speeding. Although most of the time if it is under 5 the cops do have some discretion, so it depends on the driver...how polite or rude the person is equals ticketing him/her or giving a warning.
Keep your speed down, and your friend wouldn't have to worry, or find a different road to solve the problem until the speed traps move.
And as for your thought of "I would have just kept goin", there was police in their cars or motorcycles waiting for someone with your thoughts, and then it wouldn't be just a speeding ticket. Just a word of advice, when you are told to pull over---PULL OVER.

The officer did not need to use radar. He/she only needs a stop watch if using vascar (it times you between two points). The fine carries no points (in PA). It won't be thrown out for "a waste of time" b/c he WAS speeding. He can still take time out of his day to fight it, but he can't be guaranteed it will be thrown out.

Bottom line is 1/1000000th over the posted limit is GUILTY. He was guilty and should pay, thats being responsible. That officer had half dozen renforcements a few blocks down the road to stop him if he did not obey the officers command to stop, beleived it. He also had him dead to rights on radar too, you just didn't see it. Sounds like someone needs to start learning how to abide by the law, as well as respect law enforcement.

just remember that when you tell your daughter NO one day and she blows YOUR rules off and calls you a fool or whatever. And it IS disrespectful to the rest of us who organize and make these rules - we follow them and we expect you to, missy - or else maybe you don't mind if WE break the rules WE think are silly - like for example, burglarizing your home - or cheating you at a grocery store or worse. Rules are nothing to screw around with - and if you demonstrate by example that only fools follow rules, then others feel that much more foolish to follow THEIR rules - your actions have consequences. We all contribute to this society - if you contribute a who gives a shiit attitude, then our society contains that much more who gives a shiit. Gee thanks.

I recommend your friend to go to court and talk to the prosecutor.
Most likely he can probably get away with a seat belt ticket so some assinine offence that wont effect your insurance premium or get any points.

if the cop had a radar and could tell how fast he was going then he shouldnt fight it but if he was just walking then i doubt he did so yes he should fight it. but i dont know the laws where you live so do some more research on them if you want to know more.

they give them here for 4 over. they say speeding is speeding. i say they are nazis. but they didn't ask my opinion.
if there was no radar then he has a defense. but i bet you there WAS a radar gun. they do the same thing here. stand on the side of the street, two of them and one guns and the other jumps out at you.

if your friend broke the law they should have to pay. and if your friend had just kept going they may have been able to outrun the cop but they cant outrun the cops radio. speedlimits are posted for a reason and they should be followed.
