My kids father doesn't help at all and hasn't for the past six years! I'm thinking of getting child support cause I'm tired of being nice and doing this alone! It's not fair that I have to pay for EVERYTHING! Will I get any money if he isn't working and lives in another state?

no u wont but....if u file him the family child support agency will push him to work cuz if not he will have to pay a back payment....it means even he haven't pay now....but still the child support agency charge him for it....so it will accumulate plus interest....so when ever he found a job.....NO MATTER WHAT HE NEEDS TO PAY THAT SUPPORT TO U....SO IT JUST LIKE A SAVING FOR U THEN RIGHT???

TRUST ME HE CANNOT RUN FOR THAT.....SO ITS BETTER TO FILE HIM NOW!!!....

Go ahead and file an order for child support. But if he don't have a job, you may be waiting for a while before you see a check from him.

There is also the possibility that if he is married/has a girlfriend/is living with his mother, then those will be the people paying child support for your youngens, and not him.

Another option that you can choose, is to have him sign over his legal rights to the children, so he no longer is allowed to have anything to do with them. He will not have to pay child support, and he also will not be allowed any visitations.

If he is a deadbeat and has no job, then this option should look really nice for him. Make him sign over his rights, hun.

no. unfortunately if he isnt even working then they cant even deduct it from his pay and dont look for him to give you any if he s bein paid under the table. i have same problem except my ex is in different state so its even harder for me to get anything out of him even with the state involved. i have child support case but they can only make sure he pays you by docking his check if he has a job and let me tell ya honey ive recieved maybe 90 bucks over the last 9 years from him. if you get a court case on him then he'll owe you back child support but again he can keep putting the court system off by little payments. i recieved a check 2months in a row last year for only 2 dollars. no im not kidding $2.00. an now im still not recieving anything. the man owes me over 20,000 in back child support but will i see any of it? Probably NOT. sorry hun but that is what i know and i hope it helps you. the least you could do it try for it .

Yes, there is a certain amount set even if he isn't working. Being able to collect that amount is another question. A lot of people who are ordered to pay don't pay---and the enforcement of child support is very tricky. And there are several loopholes a person can go through to not pay....
But yes, you can get an order from the court and see if that works for you...

Can't squeeze blood from a turnip. But if you go to court the judge will order him to find a job even at McDonald's and pay. Do you have a case already? If so and he is behind you can go to court and have a warrant put out for his arrest - this is true in Illinois anyway.

Him living in another state doesn't matter. but how is he gonna pay child support if he doesn't work? child support is 10% of the net pay.
