Yep, I'm not a lawyer and I'm the one who submits the H-1s for our company. Haven't had one denied yet. :)

Since H-1B petitions are filed by companies, it's not up to the individual to obtain one. Most companies prefer to have lawyers file petitions, because then they don't have to worry about the legal complications. Some companies, however, do prepare and file their own.

Note that, by law, an individual may not pay either the filing (government) fees or the legal fees for an H-1B petition. The company must pay for them, and the company can not get reimbursed by the employee--even if the employee quits 1 day after starting to work.
