I've got all website info and have made a start, would just like to know your experiences with the processes. Which banks seem to be paying straight away with not much probs & who are taking it all the way to court & how much is court charging, those kind of things. Thanks.x

Yes, I successfully claimed back 100% of my charges (running into hundreds of pounds).

It took the threat of court action, but the bank backed down before the hearing.

No one so far has lost, as long as you follow the correct procedure you will win, as the banks cannot justify their charges, and do not want to divulge their business practices in public.

You may have to have a court hearing, but its very unlikely, at the lastest the bank will usually back down just before the hearing takes place. If the bank hasn't backed down before the hearing, they won't send any defence to the hearing, so you will win by default.

HSBC are amongst the best bank for refunding fees, but any bank will do it if you push hard enough.

If you are claiming less than £5000 then you can take the case to the small claims court, and you don't need a solicitor. Court fees range from £20 - £110 depending on the amount you are claiming back, and you will these back from the bank. You can even file your claim online using the Money Claim Online website run by Her Majestys Court Service.

I didn't go to court, but years ago I went to Mexico and when I got back after a month I found out I was negative in my bank account. I knew that wasn't possible so I went in and talked to the bank. Come to find out there was a duplicate account. Two people were given the same bank account number. I got all my money back and didn't pay the overdraft fees.

i havn't personally but my sister and brother in law have both claimed back from there banks. my brother in law was the first one, this one was with hsbc for £1400 and it didn't go to court. my sister then did it for hers, this was with lloyds tsb who did go to court, she won and got back just over £2000. they said when they went to court there were about 28 other people there claiming back their charges and as far as they know everyone that day won their case. hope this helps.

www.moneysavingexpert.com is the site you want. I know a few people who have done it and won. The bank knows it is in the wrong, so they don't challenge it. They might make you close your account though.

all you have to do is write to the bank and put in the necessary legal paragraphs that you can get on some website somewhere and then the bank have to refund them
