In August 2006, at 6:30 a.m., my girls got into a fist fight in the living room of our house which is in the back of the house. The neighbors heard the commotion and called the police. The police could not enter from the front of our house because I don't have a doorbell, but I do have "Beware of Dog" sign posted bigger than life. So they came around to the side street and climbed over the fence and entered through the back door which is our kitchen. Now I have an 80# Akita/Chow dog. Which all the screaming and commotion scared him and he was in my room hiding. Well when the police walked in our living room, where my two girls and my husband were the noise had stopped so my dog came out of the room and saw the two officers and approuched them. My dog went up to the officer that was closet to him and sniffed the officers leg as the officer shook his leg to ward off my dog. As my dog was turning to walk away the other officer drew his gun and shot my dog in the back. 2' 1/4" awa

Wow, a cop shot your dog. Ok...lets see, your story lacks details. I can't begin to respond about the dog being shot by a cop; you say the dog was walking away, I'm sure the cop will say differently,maybe.

Anyway, your sign indicating "beware of dog" is actually something that works against you as you knowingly kept a dog that you felt to be problematic and your sign says so. Sorry to say many people who had this warning have been sued time and again for keeping unruly pets, no joke. Yes, it pisses you off to hear this, sorry. This does not mean the cop was right in shooting your dog thought. The fact a police officer fired a weapon inside your house during a domestic dispute is a major issue.

Turn the dogs body (if dead) or get a VBets report on bullet angle of entry and exit (if any) ex-rays help; it may show if the dog was walking away or going towards the cop; this can be important to your lawyer.
Talk to a lawyer whom deals in civil law-personal injury.

Well, you hire a lawyer and let him do his thing. Going to cost you a lot of money. Even if you win your suit, you will not get much.

There are two sides to every story. You say your harmless Akita dog wasn't bothering anyone and the cop shot it. I suspect the officer's version is going to be: "An 80 pound Akita (a Chinese attack dog) made an aggressive move towards me and I shot it because I didn't wanna get bit." The judge or jury may even hold you partly responsible since your domestic violence was the reason they were even there. Had you settled your differences with your kids without a loud, violent argument, the police would not have been there and the poor dog would still be alive.

Assuming, for the moment, that a jury and judge believe you. I suspect all you are going to get is the cost of the dog, couple hundred bucks.

I don't mean to sound harsh. But, I've seen lots of lawsuits against cops and departments. The vast majority of them are dismissed or lost. The only ones who seem to benefit from these suits are the lawyers.

What misconduct , you proudly displayed a sign that clearly stated there was a clear and present danger to anyone who entered your site.

Police are well within their rights to ensure that there is no danger to themselves. They had responded to a violent disturbance and a breach of the peace.

Domestic violence situations are one of the most dangerous scenes a police officer can attend, as they never know how they will start and end. It is not uncommon for all parties to turn on the police when they arrive.

They do not know you or your dog and based on the information YOU supplied by way of YOUR sign there was an immenant danger.

How is a police officer supposed to know when you dog will attack or not?

The breed of dog you had is notorious for unprovoked attacks and was breed to be a fighter, I would have done exactly the same thing if I was there.

Why do you need such a dog for anyway?

Good luck, just remember if and when you loose the coppers can get you to pay all costs and then they will come after you for whatever they can get.

Police unions always hire the best lawyers and they will defend their members all the way to the supreme court at no cost to their members..

Details? I would give a detailed answer now but from the minimal details in your question I can't tell if you're just out for a quick buck or actually have a valid complaint. I don't help people that sue just to put money in their pocket.

Hire a lawyer. He/she will initiate the legal proceedings by filing suits on your behalf.
