This is a hypothetical. This story did not happen to me but I want to know what
would happen.

I was on the freeway doing 40 MPH and I hit another car. My car was smashed in
in the front and nothing happened to the car in front of me. It was my fault,
but I agreed with the driver in front that we should both just leave and I'll
deal with my car. I drove away.

I called my insurance company and told them that I was backing up and someone
hit me and ran. I'm hoping my insurance company will fix the car and just be
done with the situation.

What will the claims adjuster do? And what happens if they determine that it was
not a hit n run? Are there any consequences other than me having to pay my own
to fix the car?

Again... this did not happen to me, but I want to understand the consequences
and if it's fraud.

Hit and run accidents require that the police be called. You will not only have to file a false/fraudulent claim with your insurance, but also with the police who will have your name, number and license plate info so if the driver on the freeway does decide to call the cops, your toast.

The insurance company would be notified by the police if they determine you were comitting fraud and then you are double toast.

please, anyone reading any of this, the insurance company has many resources to investigate what really happens in an accident and we do not like when people lie. It is true that many claims people are carrying high work loads and we don't catch everything but when we do, we do not overlook these things.

Your description of the accident does not match the damage (you were backing up and someone hit you, so the FRONT of your car was damaged!) LOL! Even a green adjusted will want an investigation!

the hypothetical perpetrator of this fraud will have some explaining to do!!!!

You were driving on the freeway ... at 40 mph ... and actually hit another car, damaging your FRONT end? What were the weather and traffic conditions? Heck, driving at the speed limit (55 to 65mph on the freeway) I'm known as "that slow old BA*****!" How did you catch up to, never mind hit, another car at 40 MPH on the freeway? This scenario just does not add up, and I'm not a professional accident investigator!

You need a more plausible story, even I don't believe this one!

yeah its fraud. possible jail time for insurance fraud, hit and run and leaving the scene of an accident.

usually, insurance companies require a police report that has all the details of the accident. they'll probably want to know why you didn't have one, even though it was a "hit and run". If they determine it wasn't a hit and run, they would probably deny your claim at the very least, or if they feeling like you are trying to defraud them, they could cancel your policy.

First of all the adjuster is going to look at you funny when you tell him you were backing up and smashed the front of your car.

You're too stupid to lie. Just report the accident.

Yes its fraud and yes you can be prosecuted and thrown in jail. These cases are prosecuted daily.
