I need a transcript of my 2006 tax return for an immigration form but I had no income for 2006. Would I file a 1040 and list everything as zero or is there some special form for this?

I'm in China, I've been living off of savings. It's not for me it's for wife's immigration petition. We need to jump through rings of fire to prove we're not terrorists or running a scam so they need transcripts of my tax returns for the last 3 years.

You will have to file a form 1040 (regular tax form) and a form 2555 (report of foreign income) both with zero's. The form 2555 is part of the return and will go with form 1040.

I was required to do the same when I was living overseas and applied for immigration. I filled out the 1040's and 2555's with zeros like instructed above and the INS accepted it no problem.

Regarding the cliams that you do not have to file if you had no income - the INS did not accept it, so don't follow that advice.

If they won't accept a statement that you had no taxable income for 2006, just file a zeroed-out Form 1040, 1040A or 1040EZ.

However, it takes a couple of months after the close of the current tax filing season for transcripts of returns to be available. If you need 3 years worth of tax return transcripts, get them for 2003 through 2005 and note the fact that it's not yet available for 2006.

Better yet, file a 2006 return and claim the phone tax rebate if you are entitled to it. There's a special tax return for that unique to tax year 2006; it's called Form 1040EZ-T. That way you'll have something that you can track as proof that a return was filed.

Good luck.....since you are being paid, you have to file, and then this question.....but since you are not legal, you have no record of income, yes?

The government asks that citizens pay for the stop signs and street lights that you take for granted living here, also the police and medical work. I would not think to move to Mexico or China and not speak the language, but better yet, I would expect that I support the local government in some way, since they do offer services that cost money.

Just explain to immigration that you had no income.What country are you you talking about and how can you stay there with no income?

You don't have to file if you have no income.
