I am an American citizen. My husband and I were married in Mexico. We have 2 American children. He entered the United States illegaly where we now reside. Is there any way for him to obtain legal status?

Go back to Mexico and enter legally. I'm sorry but why would you marry a man who blatantly broke the law?

Don't hold your breath waiting for amnesty. I hope amnesty does NOT happen ever again. Unfortunately, your hubby probably has to return to Mexico and will have to file for immigration the legal way. I think his chances are much, much better if he returns to Mexico voluntarily and then applies through the proper channels. If he is deported, as someone else here said, he will not have a chance to return for at least 10 years. Better to face the music now and do things right rather than for him to continue trying to hide from the authorities and all of you never knowing if and when he will be caught and deported. What kind of life is that for you all? Do the right thing. You will be glad you did.

He has to go back to Mexico. Then you need to petition him. Since he's been here illegally he'll have to wait 10 years as a penalty. After the 10 years is up he'll get a visa so he can come here legally.
