When you file your 2006 return the IRS will likely run a quick check on tax year 2005 from the information that they have available if no return was filed for 2005. If you appear to have a liability for 2005, the IRS will prepare and file a "constructive return" for 2005 on your behalf. They will then offset any refund for 2006 with their calculated balance due from the constructive return for 2005. If you have any refund left for 2006 you'll get the balance. If not, you'll get a bill.

You'll be better off financially if you file that 2005 return first as the IRS will not have your best interests in mind when they prepare that constructive return. It won't include any exemptions, deductions or credits that you may be entitled to. Even if you don't appear to have a balance due from 2005, having an open tax year for 2005 will probaby delay your 2006 refund while the IRS reviews your case.

If you owed taxes and did not pay and the computers are working properly you will not get a refund at all until this is cleared up and the fines paid.

Now it might just happen that information does not get where it should be fast enough and you might get a quick refund.

Just file and see how it goes.

If using a bank product like a 24-48 hr loan. I have found that the bank will move you to the next time frame down ( our next down is a 2 week product ) when having not filed the previous year but, will get the 2 week product. :)
