cild if he lives with a brother and has no job will a juge give him custody if child is asking to live with them? he is also behind on support and is being taken back to court for it this is when it all started?

I doubt it. If the child is being abuse or neglected and mother is unfit, then maybe but I doubt it. Most courts will grant custody to the parent who is most stable and capable. His father doesnt seem to fit that criteria. I wouldnt lose sleep over it. I used to work for an attorney and we handled alot of custody cases.

A lot of fathers threaten to sue for custody thinking that if they get the child they don't have to pay child support. But I'm sure the courts are familiar with this. I would not worry about it.

It depends on how old the child is that is asking. And its very unlikely that judge will give custody to a parent with no means to support the child.

There is NO certainty when it comes to judges decisions. As for your situation, it depends a good deal on the age of the child and whether the judge is shown that the father is responsible and capable of parenting. A judge will probably be quite leery of granting the father custody under the circumstances you outline but it depends on you and your capacity to parent too.

NUmber one if the father has no job and lives with his brother...AND has backed up child support....the answer is clearly NO...how is he going to support the child if he has no JOB..honestly..your gonna keep your child because you are the responsible parent who gets off your butt and works to support ur child...atleast I hope u have a job...but just be patient and calm down..everything will work out okay!

I certainly hope NOT!!!!!!!!!!!!!!!!!!! No job & doesn't pay support, how is he going to care for the child on a full time basis? You think the monthly child support payments cover everything? Usually not. Also, the child's age plays a factor in the decision, along with responsibilty.

It is hard to say but if your child wants to live there that might make a difference. Why not try to work a better visitation out with the father so you will not have to worry about all this.
