My ex husband has not filed taxes in the last 4 yrs,claiming he won't so as not to have to pay me back child support, is this legal even if he dosn't make enough to owe anything to the GVNT?

If he doesn't make enough to have to file a return then it is legal for him not to file.

Well, it's pretty stupid of him - he's giving up his refunds, and still owes you all the back support - if he had filed, even if his whole refund was taken for back support, at least he'd owe less.

If he doesn't make enough to have to file, then it's legal not to file. If he makes more than the limit to have to file, but just doesn't owe because he had enough withheld to pay what he owes, then he is still obligated to file, but nobody will probably push it very hard.

If he files and gets a refund, they will take it for the child support. If he doesnt make enough to be required to file, he doesnt have to file. He is still obligate to pay the child support. But, you'll have to get it some other way if he doesnt file a return.

If his income exceeds a certain amount, he is required to file. If he is required to pay child support, he probably makes enough to be required to file. The instructions for Form 1040 include filing requirements. If you have an idea how much he makes, you can probably determine if he has to file. The second link below has instruction for reporting tax fraud. If the IRS audits him, you may get the refund he never claimed.
