if they are not considered a danger to the general public, and the crime doesnt automatically call for jail time, then they get probation instead of going to the already over crowded prisons. usually this is for a first offense, if they keep their nose clean and show that they can be a productive useful member of a civilized society then they dont belong in jail, otherwise they will be caught up in the system and end up doing time.

Probation is a way for a city to pay for everybody they have in their jails. Its a pointless excercise.
I always say dont plea to anything if its your first offense for a misdemeanor because if you do all you do is give up your right to appeal. Fight it whatever they are going to give you on your plea is what they would give you if you took it all the way through the courts.

No way. Jails are crowded and so we need some way of finding a person guilty without putting them away. It stays on their record and may also require a fine. We need to revamp the entire correctional system before we find more ways to put people away.
