Hi, basically I was wondering if hosting a type of raffle on a website is illegal, or considered as gambling? Would I need a license to sell a ticket and then after a few days choose a winner, then get the gift shipped out to the winner?

This would qualify under the UIGEA's online lottery provision. I would see if there's a way to do it offline, or consult an attorney that specializes in internet regulations. I'm close to 100% sure that it is banned though.

Yeah it is basically online gambling. You collect the money and then you hand out a prize, presumably taking a cut for your time.

The new anti-gambling bill actually has provisions in it for online lotteries, making it legal to host them in the US. You might want to have your lawyer look into it and see just how easy it is to do.

The reality is that few people are going to trust you enough to send you money. PayPal is out since they don't accept any kind of wager. Most Visa and MasterCard won't work. So you need to hook up with one of these newer online ewallet sites that will allow you to accept money. Then you need to convince people that giving you money is safe and that the prize is real.
